Denied boarding, also known as overbooking, occurs when the aircraft departs but the passenger is not boarded.

This is an unfair commercial practice but widely used by airlines and hotels, namely that of accepting reservations above the actual capacity of the aircraft. In this case the airline is obliged to verify by appeal whether there are volunteers willing to give up the booking in exchange for benefits to be agreed, without prejudice to the right to choose between refunding the airline ticket within 7 days or boarding an alternative flight. Only if the number of volunteers is not sufficient, the airline can deny boarding to the passenger with the obligation to provide the financial compensation to be calculated based on the route and distance as is the case in the event of a flight cancellation or delay.
